Success! Superior Court Holds That Debtor Cannot Hide Assets By Putting In Wife's Name

Nernberg & Associates and attorney Josh Lyons obtained a $175,000 on behalf of their client. In order collect on that judgment, Attorney Lyons sought to execute upon various real property owned by the Defendant, i.e., to sell the Defendant's various houses. The trial court ruled that those houses could not be sold to satisfy the judgment because the Defendant had transferred them into his wife's name. Undeterred, Attorney Lyons appealed to the Pennsylvania Superior Court which overturned the trial court and held that the transfers were invalid and that houses were subject to execution to satisfy the judgment.
